I wish to share with you Farmers Representative update on Michigan Legislative Affairs on Auto Insurance reform.

The Senate Committee on Insurance & Banking continues to hear testimony on Michigan’s no-fault auto insurance policy, which is being classified as a “Perfect Storm”.

Matt Coffee from the Mackinac Center for Public Policy described the system as having unlimited medical benefits on one side and, now, unlimited litigation on the other.

Mayor Duggan spoke about his experience being on the other side of the issue - from running the Detroit Medical Center for nine years. Back in 1972, only 6% of a person’s auto insurance premium related to medical coverage, today that number is 42%.

This jump, the large number of uninsured drivers and the amount of claims filed, has made Michigan the state with the highest auto insurance rates in the country for years.

As Mayor Duggan pointed out, medical providers and trial lawyers are vehemently fighting reform; they have created an entirely new legal practice of suing over medical bills before they’ve been submitted. They also know that the more first party medical services a claimant uses, the more likely they are to prevail in a third party lawsuit later on.

Mayor Duggan noted that reverting to a tort system would be the best thing for the people of Detroit but he believes the first thing to do is to give the legislature time to address issues with Michigan’s no-fault system.

The average underinsurance amount is about 22 percent, though some homes are underinsured by 60 percent or more, according to Nationwide. Analytics firm CoreLogic found that about three in five American homes are insured for an average of 20 percent less than full value.

As you are aware, auto insurance rates continue to go up in Michigan increasing on average of 8-9% across the State impacted by:

- higher frequency of claims from an increase in miles driven in a good economy
- auto-related injuries and medical insurance cost rising with a 13% assessment increase per vehicle to the MCCA fund (No-Fault) http://www.michigancatastrophic.com
-increase cost to repair cars with the latest safety technology
-distracted driving being the major cause of auto accidents 68% of the time

According to the Michigan State Police traffic crash report, distracted driving was the cause of over half of the driving-related fatalities in Michigan in 2017.

Help may be on the way with auto reform legislation. SB #1 and HB #4397 set to go into effect July 1, 2020, will make sweeping changes to Michigan’s No-Fault and liability auto insurance laws intended to stabilize or lower auto premiums.

Basically, it will offer choices on medical coverage protection now known as Michigan’s No-Fault or personal injury protection (PIP) insurance provision. Many questions remain unanswered at this time, but as information becomes available, it will be posted on my website.
